Welcome to NEXTGEN INTERVIEWS. This Privacy Policy explains how PRECISE AI LIMITED ("NEXTGEN INTERVIEWS," "we," "us," or "our") collects, uses, and protects personal data. Our services are not directed to individuals under the age of 16, and we do not knowingly collect personal data from children.
This policy applies to two types of individuals:
"Customers": Our paying users (e.g., recruiters, hiring managers, business owners) who create an account to use our services.
"Candidates": Individuals who are invited by our Customers to participate in a one-way video interview.
Your relationship with us determines our role under data protection law:
For our Customers, we act as the Data Controller of your account and payment information.
For our Candidates, the Customer who invited you is the Data Controller. We act as a Data Processor on their behalf, processing your data according to their instructions.
This policy is designed to comply with the UK General Data Protection Regulation (UK GDPR), the EU General Data Protection Regulation (EU GDPR), and applicable U.S. state privacy laws.

2. How We Process Your Data
A. For Our Customers (When We are the Data Controller)
When you create an account with us, we process your personal data for the following purposes:
To Provide Our Services: To create and manage your account, provide customer support, and process payments.
Legal Basis (UK/EEA): Performance of our contract with you (Article 6(1)(b) of the GDPR).
To Respond to Inquiries: To answer your questions and requests for information.
Legal Basis (UK/EEA): Our legitimate interest to provide customer service (Article 6(1)(f) of the GDPR).
To Send Marketing Communications: With your consent, we may send you emails about our products and news.
Legal Basis (UK/EEA): Your explicit consent, which you can withdraw at any time (Article 6(1)(a) of the GDPR).
B. For Candidates (When We are the Data Processor)
When you participate in an interview, we process your personal data on behalf of our Customer (the recruiter, hiring manager, or business owner who invited you).
The Customer is the Data Controller: The Customer determines the purpose of processing your data (i.e., for their recruitment process). For details on how they use your interview data, you should refer to their privacy policy.
Data We Process on Their Behalf: This includes your name, email address, video and audio responses to interview questions, automated transcriptions of audio responses, AI-generated analysis of video content (including facial analysis and deepfake detection), and psychometric test responses and scoring.
Our Purpose for Processing: Our sole purpose is to provide the video interview service to our Customer as instructed by them.
Legal Basis (UK/EEA): Our processing is necessary for the performance of our contract with the Customer (the Data Controller).
3. Your Data Protection Rights
Your rights depend on whether we are the Controller or Processor of your data.
If you are a Customer:
You can exercise your rights directly with us. Under the UK/EU GDPR and applicable U.S. laws, you have rights of access, rectification, erasure, objection, and portability, as detailed in Sections 6 and 7 below. Please contact us at contact@nextgeninterviews.ai to exercise your rights.
If you are a Candidate:
Because the Customer (the recruiter, hiring manager, or business owner who invited you) is the Data Controller of your interview data, you must contact them directly to exercise your data protection rights (such as the right to access or delete your interview). We are legally obligated to assist our Customers in responding to your requests. If you contact us, we will forward your request to the relevant Customer who invited you to the interview.
4. International Data Transfers
Your personal data may be transferred and processed in countries outside of your own.
Transfers from the EEA to the UK: The European Commission has recognized the UK as providing an adequate level of data protection. This allows personal data to flow from the EEA to the UK without additional safeguards.
Transfers to Other Countries (e.g., the USA): If we transfer your data to a service provider in a country not deemed "adequate" (like the United States), we will ensure the transfer is lawful and your data is protected by implementing appropriate safeguards, such as Standard Contractual Clauses (SCCs) approved by UK and EU authorities.
5. AI Processing and Automated Analysis
Our Services use artificial intelligence and machine learning technologies to process video interviews and assess candidate responses. This includes:
Automated transcription of audio responses
Video analysis for authenticity verification (deepfake detection)
Facial expression and speech pattern analysis
Automated scoring of psychometric assessments
All AI analysis results are provided to assist in recruitment decisions but should not be the sole basis for hiring choices. The accuracy of AI-generated insights cannot be guaranteed.
6. Who We Share Your Data With
We do not sell your personal data. We may share your data with the following categories of third parties to provide our services:
Service Providers: Providers of hosting, IT maintenance, SaaS services (like CRM/ERP), LLM, accounting, and legal representation.
Financial Institutions: To process payments.
Public and Judicial Bodies: Where required to comply with a legal obligation.
7. Your Data Protection Rights (UK and EEA Residents)
Under the UK GDPR and EU GDPR, you have the following rights regarding your personal data:

We retain Candidate data on behalf of our Customers according to the terms of our agreement with them. 11. Data Protection Officer (DPO)

12. Governing Law
This relationship will be governed by English law, and any dispute will be resolved in the courts of England and Wales.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices or for other operational, legal, or regulatory reasons. If we make material changes, we will notify you by email (sent to the email address specified in your account) or by means of a notice on this website prior to the change becoming effective.
