CANDIDATE PRIVACY NOTICE

How your interview data is used

Who is responsible for your personal data. The organisation that invited you to complete an interview or assessment on the Platform (the Inviting Organisation) is the controller of your personal data, and decides why and how it is used. Where the Inviting Organisation is acting on behalf of another organisation (its Client) โ€“ for example, a recruitment agency assessing candidates for a Client โ€“ the Inviting Organisation will tell you in its invitation or its own privacy information whether it or its Client is the controller. Unless you are told otherwise, treat the Inviting Organisation as the controller and direct any questions or requests about your rights to it. Precise AI Limited (trading as NextGen Interviews, UK company no. 16512338) provides the Platform to the Inviting Organisation and processes your personal data as a processor on its instructions, except for the limited purposes described in the โ€œOur own processingโ€ section below (where we are controller). The Inviting Organisationโ€™s own privacy information applies alongside this notice. The Inviting Organisation is responsible for providing it to you, normally in your invitation email or on its own website; if you have not received it, ask the Inviting Organisation.

What we collect. Your name (or whatever name or identifier the Inviting Organisation enters for you) and email address, as provided by the Inviting Organisation; your video and audio recordings and the transcript of your answers; your responses to any personality questionnaire you choose to complete; AI-generated scores, commentary and recommendations; a video-integrity indicator derived from analysis of your video (our โ€œDeepfake Checkโ€); technical data such as device type, browser and IP address.

Why. To conduct and assess your interview for the purpose for which you were invited (as stated in your invitation) โ€“ including, where that purpose is recruitment, for the role(s) for which you were invited and related roles the Inviting Organisation considers you for, or, in some cases, another assessment purpose stated in your invitation (for example academic admissions or educational assessment, onboarding or accreditation checks, or the assessment of clients, suppliers or service providers); to detect manipulated or synthetic video; to produce a report for the Inviting Organisation; to keep the platform secure; and to comply with law. The Inviting Organisationโ€™s own privacy information describes the specific purpose. The Inviting Organisation is responsible for determining the lawful basis, which it sets out in its own privacy information. You will be asked for your explicit consent to the Deepfake Check before you start, and, where the Inviting Organisation has enabled it, for your consent to the personality questionnaire. You can decline or withdraw consent by contacting the Inviting Organisation, and the Inviting Organisation has agreed with us to offer an alternative way to be considered.

Our own processing. Separately from the interview data we process for the Inviting Organisation, NextGen Interviews is itself the controller of a limited amount of technical data (such as your IP address, device and browser information and access logs) that we process to keep the platform secure, to detect fraud and misuse and to comply with law, relying on our legitimate interests in operating a secure service. This is described in our Privacy Notice at https://nextgeninterviews.ai/privacy.

Sensitive and biometric data. Sensitive and biometric data. The Deepfake Check analyses the visual characteristics of your face and video to detect manipulation or synthetic generation. It runs on every interview recorded on the platform. Depending on where you live, this may be treated as biometric or special-category data. Your personality questionnaire results are inferences about your characteristics; the questionnaire is offered only where the Inviting Organisation has enabled it. These features are used only for the purpose for which you were invited.

AI and decisions about you. AI is used to transcribe and analyse your answers. The outputs are provided to the Inviting Organisation to support โ€“ not replace โ€“ human judgement. The Inviting Organisation has agreed not to make decisions with significant effects on you solely by automated means without human review. You can ask the Inviting Organisation for human review, to express your point of view, and to contest a decision.

Who sees it. The Inviting Organisation and the people it involves in the recruitment or assessment process. The Inviting Organisation may download your interview report or transcript and, where the Inviting Organisation is acting on behalf of a Client, share it with that Client; the Inviting Organisation is responsible for that sharing, and the Client does not have access to the platform itself. NextGen Interviews and its hosting, infrastructure and AI service providers process your data to provide the platform under strict contracts that prohibit using it for their own purposes or to train AI models. Our service providers (sub-processors) fall into the following categories: cloud hosting and storage, video processing, AI transcription and analysis, email delivery, and security and monitoring. Where any of these providers process your data outside the United Kingdom, the safeguards described under โ€œWhereโ€ below apply. If you need more information about our sub-processors in order to exercise your rights, contact the Inviting Organisation or privacy@nextgeninterviews.ai and we will provide what is reasonably necessary. We do not sell your data. Our staff do not watch or listen to interviews. Our technical team may access a specific recording only where the Inviting Organisation asks us to fix a technical problem with it (for example a file that will not play), or where this is necessary to keep the platform secure or to comply with law. Any such access is logged, limited to what is needed, and carried out by staff bound by confidentiality.

Where. Where. Your data is hosted in the United Kingdom. Where it is processed outside the United Kingdom, safeguards recognised under UK data-protection law (such as adequacy regulations or the ICOโ€™s International Data Transfer Agreement) are used, and, for data subject to EU law, the EU Standard Contractual Clauses. We do not currently have an establishment or representative in the EU or EEA; if that changes we will update this notice.

How long. The Inviting Organisation decides how long your data is kept and should tell you in its privacy information. When the Inviting Organisation deletes your interview, we delete it from our live systems within 30 days. If the Inviting Organisationโ€™s account closes, your data is retained for an export period of 30 days (during which the Inviting Organisation can request a copy) and a further dormant period of 30 days during which it is not accessible, and is then deleted from our live systems; copies in encrypted backups are not accessed and are overwritten within a further 30 days.

The Inviting Organisation can ask us to delete your data sooner. Because we act on the Inviting Organisationโ€™s instructions, we cannot ourselves delete, change or hand over your interview data at your request; only the Inviting Organisation can instruct that. If you contact us, we will pass your request to it. The exception is where the Inviting Organisationโ€™s account has closed and it does not respond, in which case we will act on your request directly as described below and in the Candidate Terms.

Your rights. You have the right to access, correct, delete and restrict the use of your data, to object to processing, to data portability, to withdraw consent where processing is based on consent, and rights in relation to automated decision-making. Contact the Inviting Organisation to exercise them (or contact us for the technical data we control). If the Inviting Organisation does not respond to your request after we have referred it to them, or has closed its account and cannot be contacted, we will confirm whether we still hold your recordings and results, provide you with a copy, and delete them on request, unless the law requires us to keep them. We cannot review assessment outcomes or decisions made by the Inviting Organisation. We automatically delete all data for closed accounts within 60 days of closure in any event (plus a short backup period). You can also complain to the UK Information Commissionerโ€™s Office (ico.org.uk) or your local data-protection authority.

Cookies. The interview platform uses strictly necessary cookies to run your interview and keep it secure. See our Cookie Notice at https://nextgeninterviews.ai/cookies.

Consent requested before your interview

By proceeding you agree to the Candidate Terms and acknowledge this Candidate Privacy Notice.

โ˜ I consent to my video being screened for signs of digital manipulation or synthetic generation (the โ€œDeepfake Checkโ€). This screening is built into every interview on this platform and cannot be switched off. Giving this consent is not a condition of being considered for the role or purpose I was invited for. If I prefer not to consent, I simply do not proceed, and the Inviting Organisation will offer me another way to be considered and will tell me what that is. I can withdraw consent later by contacting the Inviting Organisation.

Consent requested before the personality questionnaire (where the Inviting Organisation has enabled it)

โ˜ I consent to completing the personality questionnaire. I understand I can decline by not proceeding, and that I can withdraw consent later by contacting the Inviting Organisation.
