1. Who we are and who you are dealing with. This interview platform is operated by PRECISE AI LIMITED, trading as NextGen Interviews, company number 16512338, Level 1, Devonshire House, 1 Mayfair Place, London, W1J 8AJ, United Kingdom. You have been invited to use it by the organisation that sent you the invitation (the Inviting Organisation). The Inviting Organisation may be the organisation hiring for the role, or a recruitment agency or similar business acting on behalf of another organisation (its Client), or, in some cases, an organisation using the platform for another assessment purpose stated in your invitation (for example academic admissions or educational assessment, onboarding or accreditation checks, or the assessment of clients, suppliers or service providers). The Inviting Organisation may be presenting the platform under its own brand. The Inviting Organisation – not NextGen Interviews – decides which questions to ask, which features to enable, how to assess you, and what happens next. We provide the technology on the Inviting Organisation’s behalf.

2. Agreement. By clicking “Start interview” or recording a response you agree to these Candidate Terms. If you do not agree, do not proceed, and contact the Inviting Organisation about alternative ways to be considered.

3. Age. You must be at least 16 years old to use the platform. If you are under 16, do not proceed.

4. What the platform does. The platform will: record video and audio responses to interview questions; transcribe and analyse your responses using artificial intelligence to produce scores and commentary for the Inviting Organisation; and screen your video for signs of digital manipulation or synthetic generation (our “Deepfake Check”) and provide an integrity indicator to the Inviting Organisation. If the Inviting Organisation has enabled it and you choose to take part, the platform will also offer a Big Five personality questionnaire. The Candidate Privacy Notice explains the data involved.

5. AI-assisted assessment and human review. AI-generated scores and commentary are provided to the Inviting Organisation as decision-support. The Inviting Organisation has agreed with us that decisions about you will not be made solely by automated means without meaningful human review. If you have concerns about how AI was used in your assessment, or wish to request human review, contact the Inviting Organisation.

6. Video-integrity screening and consent. Every interview recorded on the platform is screened for signs that the video has been manipulated or synthetically generated (our “Deepfake Check”); this screening is an integral part of the platform and cannot be disabled for an individual interview. The result is provided only to the Inviting Organisation. It indicates likelihood only; the screening is not infallible and may produce incorrect results. If it affects a decision about you, the Inviting Organisation has agreed to give you an opportunity to respond. You will be asked for your explicit consent to this screening before you start, and, where the Inviting Organisation has enabled it, for your consent to the personality questionnaire; you may decline either. Declining the screening means you cannot take the interview on the platform, because the screening cannot be separated from it; contact the Inviting Organisation, which has agreed with us to make an alternative way to be considered available to you. You may withdraw consent later by contacting the Inviting Organisation; withdrawal does not affect processing carried out before it, and the Inviting Organisation will then consider you by an alternative method.

7. Your recordings and your licence. You own your recordings and responses. By taking the interview you grant: (a) the Inviting Organisation a non-exclusive licence to view, store, analyse and share your recordings, transcripts and results with people involved in the recruitment process (including, where the Inviting Organisation is acting on behalf of a Client, that Client) solely for the purpose for which you were invited (as stated in your invitation), including considering you for the role(s) or related roles where that purpose is recruitment, and for the Inviting Organisation’s lawful record-keeping in connection with that purpose; and (b) NextGen Interviews a limited licence to host, store, process and analyse your recordings solely to provide the platform to the Inviting Organisation, to provide technical support (which may involve our technical team accessing a specific recording, with that access logged, only where this is necessary to fix a fault), and to comply with law. We do not use your recordings to train AI models and do not use them for any other purpose.

8. Your conduct. You agree to: provide truthful information and your own genuine responses; not use any software, filter, avatar, deepfake, voice-changer or other means to alter your appearance or voice, or have someone else take the interview for you; not record or redistribute the Inviting Organisation’s questions; and not attempt to interfere with, scrape or reverse engineer the platform. This does not prevent you from using assistive technology (for example screen readers, captioning, speech-generating devices or hearing aids) or any adjustment agreed with the Inviting Organisation under clause 10, provided it is not used to misrepresent who you are or to have someone else answer for you. Your interview link and any Candidate materials are for you only; you may not use them to act as, or on behalf of, an employer or other organisation.

9. Technical requirements; unfinished or failed interviews. You need a compatible device, camera, microphone and a stable internet connection. We recommend a quiet, well-lit space. If you experience technical difficulties, contact the Inviting Organisation, who can arrange a retake or alternative. If you start an interview but do not finish it, or a recording fails to upload, any responses that were successfully recorded are stored and made available to the Inviting Organisation in the same way as a completed interview, and the Inviting Organisation decides whether to invite you to retake it. Whether an interview can be paused, resumed or retaken depends on the Inviting Organisation’s settings and is shown on screen before you begin. We are not responsible for failures caused by your device, browser or internet connection.

10. Accessibility and adjustments. If you need reasonable adjustments to take part (for example more time, an alternative format, or an alternative method of assessment), contact the Inviting Organisation before starting. The Inviting Organisation has agreed with us to consider such requests.

11. Our responsibility to you. We will provide the platform with reasonable care and skill. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or anything else that cannot be limited by law, or affects your statutory rights as a consumer. We are not responsible for the Inviting Organisation’s decisions, questions, communications or conduct, or for loss that was not foreseeable when you started the interview.

12. Your data and rights. The Inviting Organisation (or, where it has told you so, its Client) is the controller of your personal data. We act as processor on its behalf, except as set out in the Candidate Privacy Notice. To exercise your rights (access, correction, deletion, objection, restriction, or to complain about automated decision-making), contact the Inviting Organisation using the details in its own privacy information or in your invitation. If you contact us instead at privacy@nextgeninterviews.ai, we will pass your request to the Inviting Organisation promptly. If the Inviting Organisation cannot be contacted, the Candidate Privacy Notice explains what we will do with your request. 13. Cookies. The interview platform (including where it is presented under the Inviting Organisation’s own domain) uses strictly necessary cookies and similar technologies to run the interview, keep your session secure and remember your progress. We do not use advertising cookies on the interview platform. Where optional analytics cookies are used, you will be asked for consent. 14. Changes. We may update these Terms; the version shown when you start an interview applies to that interview.

15. Law. These Terms are governed by the law of England and Wales. If you live in another country you also have the benefit of any mandatory consumer protections of that country, and you may bring a claim in your local courts.
